Chapter 10 - Powers Delegated to the United States
I know of no safe depository of the ultimate powers of the society but the people themselves; and if we think them not enlightened enough to exercise their control with wholesome discretion, the remedy is not to take it from them, but to inform their discretion by education. This is the true corrective of abuses of constitutional power. (Thomas Jefferson, 3rd U.S. President) In opening this chapter we are compelled to remind you that it was not the People who ordained the constitution as is commonly taught in schools and near universally believed because of the Preamble “We the People….”. We again elaborate directly from The Encyclopedia of the American Constitution, copyright 1986, by Macmillan Publishing Company, A Division of Macmillan, In. 866 Third Avenue, New York, NY 10022 Page 367  CONSTITUTIONAL HISTORY before 1776:   “The opening words of the United States Constitution, "We the People," startled some of the old revolutionaries of 1776.  Patrick Henry, after expressing the highest veneration for the men who wrote the words, demanded "What right had they to say, “We the People.””   "... Who authorized them to speak the language of We, the People, instead of We, the States?"  It was a good question and, as Henry knew, not really answerable.  No one had authorized the members of the Constitutional Convention to speak for the People of the United States.  They had been chosen by the legislatures of thirteen sovereign states and were authorized only to act for the governments of those states in redefining the relationships among them.  Instead, they had dared not only to act for "the People of the United States" but also to proclaim what they did as "the supreme law of the land," supreme apparently over the actions of the existing state governments and supreme also over the government that the Constitution itself would create for the United States." This is most revealing in the structure of power. It was the sovereign states and NOT the People that ordained the new Constitution. Next we look at the new entity called “United States”. Now what was this entity called the United States? You might be surprised to learn that it was deemed a corporation in a Supreme Court case:   “The United States of America are a corporation endowed with the capacity to sue and be sued, to convey and receive property.” 1 Marsh. Dec. 177, 181.   “The United States Government is a foreign corporation with respect to a state.” Volume 20: Corpus Juris Sec. §1785: NY re: Merriam 36 N.E. 505 1441 S.Ct.1973, 41 L.Ed.287 Its primary power was to regulate commerce. Please indulge our elaboration. What is commerce? [2] (Please read the Footnote). It is the movement of goods through navigation across fictional international borders for resale. It is not, nor ever was, the private affairs of private people transacting among themselves. Trade amongst and between people is their unalienable right. The states at the time were sovereign and independent. Court cases confirm that they were foreign to each other. They were literally free and independent separate nations that entered into a commercial and defense compact with each other. Originally, they accomplished that end through the Articles of Confederation. These articles were weak in that they did not provide sufficient means to raise revenue for the central government. The states then convened to create the Constitution with greater taxing powers over commerce. Their agent was the corporate United States. We will now show you how you have been placed, through shenanigans, into commerce. You have been fraudulently placed into commerce so that the U.S. Government can use its supreme power (to regulate commerce) to regulate you and everything you do on the land. The footnote tells you more of commerce. But more obvious proof is the following. If you hold a commercial license and drive a truck for a living, you deliver a “Bill of Lading” along with the cargo in the back of your big rig. What jurisdiction (law) are you traveling within? Your commercial license implies you are in commerce. But what places you in commerce? Note the definitions of a Bill of Lading and a Way Bill from the Law Dictionary of Bouvier:   BILL OF LADING, contracts and commercial law. A memorandum or acknowledgment in writing, signed by the captain or master of a ship or other vessel, that he has received in good order, on board of his ship or vessel, therein named, at the place therein mentioned, certain goods therein specified, which he promises to deliver in like good order, (the dangers of the seas excepted,) at the place therein appointed for the delivery of the same, to the consignee therein named or to his assigns, he or they paying freight for the same. 1 T. R. 745; Bac. Abr. Merchant L Com. Dig. Merchant E 8. b; Abbott on Ship. 216 1 Marsh. on Ins.   As is clearly evident, the Bill of Lading is a list of goods that a captain of a ship signs for, and then navigates those goods over the sea to a destination. The question is, “Why are truck drivers carrying Bills of Lading when plainly by our own observations they travel on the land?” However, just so one does not mistake that the Bill of Lading is perhaps a kind of Bill that may be used for land as well as sea, let us look at the Bill for goods transported over land, the “Way Bill”, which is defined by Bouvier’s Law Dictionary.   WAY BILL, contracts. A writing in which is set down the names of passengers, who are carried in a public conveyance, or the description of goods sent with a common carrier by land; when the goods are carried by water, the instrument is called a bill of lading. (q.v.) Defined from Bouvier’s Law Dictionary   You may now state, “Oh, this is just plain silly! It is just an error for truckers, who are in commerce, to use the Bill of Lading.” But consider this, when the big rigs reach their destinations they back their big rigs into the “bay” and up to the loading “dock” of a store, building etc. And yet, the stores or buildings are on the land. If you don’t believe it, ask a trucker. Now, “What about you?” Could you be in commerce (traveling on the sea) when you are traveling in your automobile? We ask you this, “Have you ever passed raised or painted islands that were in the middle of the road? Of course you have. The law states that it is a violation of law, or forbidden for you to drive over the island. Think about ships, can they maneuver over islands? No, they can’t. Why the use of the term “island” when clearly you can only drive on the land? Also, do you often have a passenger in your vehicle? Black’s Law Dictionary defines passenger as follows:   PASSENGER – One carried for hire, or reward, as distinguished from a “guest” who is one carried gratuitously, that is, without any financial return except such slight benefit as is customary as part of the ordinary courtesy of the road. Duncan v. Hutchinson, 139 Ohio St. 185, 39 N.E.2d 140, 142.   As you know, the traffic laws titles those, other than the driver, as passengers and not guests. When you are driving do those, who are traveling with you, fit the term passenger or guest? Again, the law deems them to be passengers, though they are most certainly guests as defined above. We know if you have been driving for a length of time, you have stopped at a gas station or hundreds of stations over the course of your life. Do you know what a station is? Let’s define it by Bouvier’s Law Dictionary:   STATION, civil law. A place where ships may ride in safety. Dig. 49, 12, 1, 13; id. 50, 15, 59.   Certainly, the term station applies to the sea, but, the Lex Mercatoria stated that commerce applied to the navigation of the sea. It must be impossible to jump to the conclusion that your automobile is a ship or vessel on the sea, or is it? (See the end of this chapter on page 31.) In the United State there has been a War on Drugs for at least 30–40 years. These laws make it illegal to have drug paraphernalia, which is by law defined as contraband. (Reference: Wikipedia) “Drug paraphernalia is defined by the American federal Drug Enforcement Administration as any equipment, product, or material that is modified for making, using, or concealing illegal drugs such as cocaine, heroin, marijuana, and methamphetamine, those items used with a drug.” Do you know precisely what contraband is? Do you know under what law the word ‘contraband’ falls? Does it fall within the Common law, Equity law (contract), or Admiralty (the law of the sea), which includes Maritime?
