Rudolf von Jhering (1818–1892) is along with Carl von Savigny the most well known representative of Pandekten science in the 19th century. We still do not know much about Jhering’s position in the first ten years of his work (1842–1852) on the contemporary debate about the basic issues of substantive law and legal science. Two series of articles that appeared in 1843 and 1845/46 in the “Literature Newspaper” give us new insights into the thinking of the young scholar. Although they appeared anonymously, the synoptic linguistic and content analysis featured in the first part of the present volume shows that the articles were, in all probability, written by Jhering. The second part of this volume contains a transcription of two handwritten manuscripts originating from Jhering’s earlier period and found in his estate. The first deals with the Roman ius gentim and is the original version of Jhering’s later main work “The spirit of Roman Law at the various stages of its development” (Geist des römischen Rechts auf den verschiedenen Stufen seiner Entwicklung; 1852–1865) and the second is a draft lecture on the “Comparison between the development of law in ancient times and today” (Gegensatz der Rechtsbildung des Alterthums und der modernen Zeit), which was considered to have been lost up to now.>
